I’ve discovered that the most challenging parts where students struggle are using the Oxford Standard for Citation of Legal Authorities (OSCOLA) and IRAC.

Both frameworks are required for legal analysis and demand strong reasoning, technical grammar, and formal writing tone.

Since most students lack strong analytical skills and basic structure guidance, they end up compromising on their grades.

In this blog, I’ll provide a quick overview for aspiring lawyers on how to upgrade from a C to an A, with practical steps for writing high-quality law assignments.

First, Set the Legal Foundation

You should start with proper planning by listing down the learning outcomes, legal issues, and goals your law assignment will cover.

Dissect the Legal Prompt’s Key Questions:

Breaking down the set of legal instructions into individual parts is necessary to grasp what your examiner is asking, what to add and how to approach the task all depends on the instructions. 

  • Find out whether the question is asking you to advise a client, assess a legal regulation, or judge case law. 
  • Identify the main subject and any specified topic.
  • Note down the word limit, formatting pattern, and citation style(Simple but really important step).
  • Address the issues with clear phrases.
  • Write down each distinct aspect of a crime separately.
  • Don’t include unnecessary information while stating facts regarding legal rules.
  • Create a proper plan to find the legal problems you must explain to answer the prompt.
  • Organize your text around Issue, Rule, Application, and Conclusion to balance a clear word flow.

Research the Case Law

It’s really crucial to find the most convincing authorities and reputable sources on a given subject to search primary sources.

How to search for the leading topic?

  • Start your research with databases like Westlaw and look for secondary sources in encyclopedias that cite the basic cases defining rules.
  • In case you settle on a statute, convert to the annotated version and scroll down to the “citing references” tab.
  • Click on a related key number within a relevant case to check if it addresses the legal point you want
  • Once you find a core case, sort your results by clicking on the “Citing references.”

Structure your notes following the Legal rule.

  • Create a digital outline for your topic by dividing it into subtopics.

Create a Draft with the IRAC Method

The IRAC stands for Issue, Rule, Application, and Conclusion. It is a standard method to structure legal claims logically.

Did (Person’s Name) carry out (Crime/Offense), as stated by (Mention the code/act/statute) when (they proceeded)?

A super important tip: Write this as a closely-focused question of law and fact, and don’t jump to answer immediately.

Rule:

Under (Statute, e.g., Section Y of the Penal Code), the aspects of (Crime) are:

  1. (Aspect 1)
  2. (Aspect 2)

Actionable tip: State the exact law or case law. If applying case law, discuss the ruling precedent.

Application or Analysis:

In the current case, (Person’s name)’s actions justify the needs of (Crime) as highlighted in (Statue).

Actionable tips:

  • Link all aspects one by one directly to the facts.
  • Compare with reference to a previous case.
  • Briefly predict and argue defenses raised by the opponent side to carry the upper hand.

Conclusion:

As a result, (Person’s name) is found legally (guilty/responsible) of committing (Crime) because (they failed to follow the laws).

Refine the Text for Accuracy

In my law assignments, the three factors I considered were precision, clarity, and conciseness. That is because removing unnecessary words improves readability and the value of legal claims.

Here is how you can also do it:

The first thing that you have to do is to scan your document for complex wording. Keep the sentence simple with plain English. Instead of using words like “Aforementioned,” use “these or those”.

Your second step will be shifting from passive to active voice. A passive voice hides the main point of a sentence. Writing in an active voice reduces the word count and makes the point direct which makes it easier for the reader to understand. 

For example: In a passive voice, you would write “The document was signed by the accused.” This sentence carries 7 words.

Now, replacing it with active, it would be like “The accused signed the document.” Just 5 words and your point is made.

Keep in mind that you do not convert clean verbs into long nouns. It compels you to add weak extra verbs to complete the sentence.

Take this example.

Noun form: The defense reached an agreement. Vs Verb form: The defense agreed.

See the difference?

Be aware of couplets and triplets. These are legal phrases that carry the exact meaning for multiple words. Only pick one word and remove the rest.

For example: Instead of using “Null and void”, use void.
